Ltd., a company incorporated under the Companies Act, 1956, having its registered office at 230/1A, Kumudham Nagar, Vilankurichi, Keeranatham, Coimbatore North, Coimbatore – 641035, Tamil Nadu, India (hereinafter interchangeably referred to as, “We” or “Us” or “Our” or the “Company” or “Fertilia”), and you (hereinafter referred to as, “You” or “Your”), as the User accessing our website hosted at https://fertilia.in and/ or availing any of the services provided by Us in the website or otherwise.
The Terms of Service shall govern your use of our website and the services offered through our website, therefore, please read and understand the Terms of Service before you access the services, view, download, install or Register with or use the Platform. If you are not agreeable to this Terms of Service, then you shall not access, view, or use our website or the services offered through our website, and if you are accessing, using, or viewing the Platform, then you shall delete the account and desist from such accessing, using, or viewing the Platform.
By accessing, viewing, and/or using the Platform or the services offered through the Platform, you voluntarily and unconditionally accept to and agree to be bound by the Terms of Service and the Privacy Policy (defined below).
USER SERVICES
The website offers the following services to the user.

- Diagnostic services through Diagnostic Laboratory partners
- Free or Paid webinars on health education related to infertility and women’s health
- Wellness/ Counseling programs
ACCESS TO DIAGNOSTIC SERVICES
The website may permit an User to schedule an appointment with and/or seeking services of a Diagnostic Laboratory, on payment of consideration as may be stipulated by the Company, and subject to availability of such services.
The services offered by a Diagnostic Laboratory may be performed at the premises of such Diagnostic Laboratory or at the residence of the Registered User, as the case may be.
The services offered by a Diagnostic Laboratory shall be governed by the policies, rules and regulations of such Diagnostic Laboratory, and the Registered User in availing such services from a Diagnostic Laboratory agrees to be bound by such policies, rules and regulations. Service fee
Users may avail the Services by availing one of the payments plans available on the Platform, such payment may be made directly via the Platform. Payment against Fees can be made online through credit Card/internet banking etc. or any mode of payment which is made available to the User in the Platform.
REFUND POLICY
Thank you for choosing our services! We understand that unforeseen circumstances may arise, so this policy outlines our approach to refunds for both one-on-one consultations and webinars.
One-on-One Consultations
Due to the personalized nature of one-on-one consultations with Dr. Suganya Venkat, refunds are not available. However, we understand that scheduling conflicts can happen. If you are unable to attend your scheduled consultation, you are welcome to reschedule for a later date and time subject to Dr. Suganya Venkat’s availability. Please provide at least 24 hours notice for rescheduling requests.
Webinars
We strive to deliver valuable and informative webinars. We offer two options for those who are unable to attend their registered webinar or find it not useful:
Reschedule: If you are unable to attend your registered webinar date, you can reschedule for a later session. Please notify us of your preferred new date at least 24 hours before the original session.
Full Refund: If you attend the webinar but find it does not meet your expectations, you may request a full refund by emailing Dr. Suganya Venkat at [email protected] within 7 days of the webinar. Please include your name, the date of the webinar, and a brief explanation for requesting a refund.
Processing Time: For approved refunds, please allow 5-7 business days for the refund to be processed and reflected in your account.

ELIGIBILITY
By using this website, you affirm that you are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, warranties set forth in the Terms and Conditions, and to abide by and comply with the terms stated therein. Registration of User in the website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the applicable law including minors, un-discharged insolvents, or person with unsound mind etc. and are not eligible to use the Platform.
CONTENT SCRAPING
No person (including a User, Doctor, Alternative Medicine Practitioner, or Wellness Professional) shall copy, transfer, download, republish, sell, duplicate, or “scrape”, for commercial or any other purpose whatsoever, the contents or information made available on the Platform including Directory Listing Services, academic articles, and queries, in whole or in part, in any medium whatsoever.
LINK TO THIRD-PARTY WEBSITES OR APPLICATIONS
The Platform may consist / provide links to third-party websites and applications including but not limited to payment gateways, messaging services, video-conferencing applications, and vendor services. The Platform does not have any control offered by such third-party websites or applications. This Terms of Service shall not govern usage of such third-party websites or applications by a User or Registered User or Registered Doctor. Usage of such third-party websites or applications by a User or Registered User or Registered Doctor shall be governed by terms of services and privacy policy of the respective third-party website or application.
COOKIES
The website uses cookies to enable the Company to retrieve information, the functionality of the Platform, and providing better user experience of the Platform. Company’s affiliate partners may also use cookies for providing their services.
FORCE MAJEURE
No party to this Terms of Service shall be liable to the other for any failure to perform any obligation under any Terms of Service which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood, epidemic, pandemic, or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any party to this Terms of Services affected by such event shall forthwith inform the other party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Terms of Service contained herein.

Procedure and practices in relation to collection, use, sharing and protection of the information obtained from a User, Registered User shall be governed by the Privacy Policy of the Platform made available at https://www.fertila.in/privacy
The Privacy Policy shall be deemed to be an integral part of this Terms of Service.
By causing the accessing, viewing and/or using of the website, User is deemed to have read, understood and voluntarily agreed to the Privacy Policy.
CHANGE TO TERMS OF SERVICE
This Terms of Service may be revised or updated from time to time, and the User shall check the Terms of Service frequently. In the event of any significant change to this Terms of Service, the User shall be intimated through a message in the Platform and/or e-mail to the address provided, about such change, and consent of the User, may be obtained the revised version of this Terms of Service, if required under law. Continued use of the Platform and/or service(s), after the intimation of the change to this Terms of Service, shall constitute express consent to such change.
DISCLAIMER
This Site is only a platform to impart education and act as a channel for booking consultations with a registered medical practitioner or booking diagnostic tests with accredited diagnostics laboratories.
The information contained in this website is for general information purposes only. While We endeavour to keep the information up to date and correct, We make no representations or warranties of any kind, expressed or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance You place on such information is therefore at your own risk. In no event will We be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.
LIMITATION OF LIABILITY

TERMINATION
Your access to the Platform and the services offered through the Platform may be terminated for any of the following reasons:

To comply with any order issued or proposed to be issued by any governmental agency;
If performance of any term of these Terms of Service by either party would cause it to be in violation of law.
Company determines in its sole discretion that access to or use of the website or services by you may jeopardise the Company or services or the confidentiality, privacy, security, integrity or availability of information within the Platform, including the reputation of the Platform.
Any person is or may be making unauthorised use of the website with any credentials assigned to you.
DISPUTE RESOLUTION
Any controversy, claim, dispute or difference arising out of this Terms of Service executed in furtherance thereof, or any alleged breach of this Terms of Service executed in furtherance thereof, shall be resolved by means of binding arbitration before a single arbitrator in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The award given by such an arbitrator shall be final and binding on all the parties to this Terms of Service.
The arbitration shall be held in Coimbatore, Tamil Nadu, India. No demand for arbitration shall be made after the date when the institution of legal proceedings based on such claim or dispute would be barred by the applicable statute of limitation.
Subject to Sections 39.1 and 39.2 hereinabove, courts in Coimbatore, Tamil Nadu, India, shall have exclusive jurisdiction over any dispute that arises out of this Terms of Service.
SEVERABILITY
This Terms of Service supersedes all prior agreements, written or oral, between the parties hereto concerning the subject matter hereof. Whenever possible, each provision of this Terms of Service shall be interpreted in such manner as to be effective and valid under applicable law, but if any provision of this Terms of Service is held to be invalid, illegal or unenforceable in any respect under any applicable law or rule in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision or any other jurisdiction, but this Terms of Service shall be reformed, construed and enforced in such jurisdiction as if such invalid, illegal or unenforceable provision had never been contained herein.
